Builder Partners is a statewide coalition formed in 2003 to facilitate dialogue and action on issues that affect the building and construction industry. Started by three firms, we now have more than 8,000 members employing over 250,000 people in every major city in New York.

Builder Partners has identified the following as key initiatives for 2008.
1. Reform of Labor Law Sections 240/241. This antiquated law is creating a crisis in the building and construction industry by imposing absolute liability on the organization for falls from height regardless of the employee’s actions and/or culpability. Premiums continue to escalate at uncontrolled rates while total coverage is decreasing. New York has only three private carriers willing to write general liability insurance. Even those carriers are now writing coverage that excludes 240/241 coverage.
It is not just the construction industry that is impacted by 240/241. Business owners having work done on their premises have also had to pay large judgments under 240/241, even though the injured worker was employed by a subcontractor. Soon enough, home owners could find themselves faced with similar issues.
Builder Partners supports a comparative negligence standard for all labor law 240/241 cases. The actions of the injured work should be used in any proceeding involving gravity related incidents. We will continue to push legislation that creates an even playing field for good, safe contractors.
2. Meaningful Workers’ Compensation reform. 2007 saw the Governor and Legislature enact the first changes to the Workers’ Compensation system since 1996. While we applaud their efforts, many small details are left unfinished and on the table.
In 2008, we will work with our partners and the legislature to finalize key components that will take ambiguity out of the system and create a process where workers get the treatment they need and employers continue to see reductions in premiums.
3. Support statewide economic development initiatives. Economic development continues to be a focus of Builder Partners. In 2008, we will work to ensure that the capital developments funds are in place to grow our infrastructure. Further, with the DEC and DOL taking more aggressive postures, we will need to work with them to ensure they have the proper information when making policy decisions. From Storm Water regulations to wage enforcement issues, Builder Partners will continue to pursue sound economic development policies and oppose restrictive measures.
